Terms of Service

These terms govern your use of Whalur. By creating an account or using the site you agree to them. Read section 1 even if you read nothing else — it is the part that matters most to your money.

1. Risk disclosure — Whalur is not financial advice

Whalur is a market research and statistical measurement tool. It is not an investment adviser, a broker-dealer, or a financial planner, and nothing it produces is financial, investment, tax or legal advice.

Everything on this platform — hypotheses, mechanisms, backtests, rankings, expected-value figures, signals and alerts — is a historical measurement of how a described market behavior performed on past data, under assumptions that will not match your broker, your fills, your fees, or your timing.

Past performance does not predict future results. A mechanism that produced positive expected value across years of history can lose money starting tomorrow, and a backtest can be positive for reasons that have nothing to do with any real edge.

All trading risks capital. You can lose money, including more than you deposited if you use margin, options, or leverage. Do not trade money you cannot afford to lose.

You are solely responsible for your own trading decisions. If you place a trade because of something you saw on Whalur, that is your decision and your risk. We do not manage your money, we do not know your circumstances, and we accept no responsibility for your trading results. Consider speaking to a licensed professional who does know your circumstances before you act.

This disclosure applies equally to research published by other users, including research you pay a creator for. Whalur does not endorse, verify or vouch for any creator's claims.

2. Your account

You must be at least 18 years old to use Whalur. You must give an accurate email address, keep your password secret, and keep your login credentials to yourself — accounts are for one person, not for sharing. You are responsible for everything done under your account. Tell us at [email protected] immediately if you think someone else has access to it.

3. Acceptable use

You agree not to:

  • scrape, bulk-download, or resell Whalur's research, rankings or signals outside the creator marketplace;
  • attempt to bypass tier limits, paywalls or entitlement checks, or use another account to do so;
  • attack, overload, probe or reverse-engineer the service, or attempt to access data belonging to other users;
  • upload unlawful content, malware, or anything that infringes someone else's rights;
  • use Whalur to manipulate a market, or to promote a security you hold without disclosing it;
  • impersonate anyone, or present Whalur output as personalised investment advice to others.

We may suspend or remove accounts that break these rules, and we may rate-limit or block automated traffic that degrades the service for others.

4. Plans, billing and cancellation

Whalur has three plans:

  • Free — $0. One active hypothesis at a time, the full backtest engine on it, the public hypothesis library with top-ranked entries withheld, and mechanisms, signals and alerts.
  • Basic — $29 per month. Unlimited hypotheses, private hypotheses, the full top-ranked table, 20 AI strategy builds per month, and friends.
  • Pro — $99 per month. Everything in Basic, plus unlimited AI strategy builds, the ability to sell access to your private research, and a priority backtest queue.

Paid plans are billed in US dollars through PayPal. A subscription renews automatically every month until you cancel it. By subscribing you authorise PayPal to charge your chosen funding source on each renewal date.

You can cancel at any time from your account page. Cancellation stops the next renewal; it does not end your plan immediately. Your paid features stay available until the end of the period you have already paid for, after which the account returns to the Free plan.

We do not refund partial months. If you cancel mid-period you keep the remainder of that period and are not charged again. Upgrading or downgrading changes what you are billed on the next renewal.

If a renewal payment fails, we may downgrade the account to Free until payment succeeds. We may change plan prices or contents with at least 30 days' notice by email; the new price applies from your next renewal after that notice, and you can cancel before it takes effect.

5. Creator marketplace

Pro members can sell other users access to their private research. These terms apply to those sales:

  • You set the price. The creator decides what access to their research costs.
  • Whalur takes a 30% platform fee; the creator receives 70% of the gross sale amount. The fee covers payment processing, hosting, and running the marketplace.
  • Payouts are made manually to the PayPal address on the creator's account. They are not instant and are not automated. Tell us the correct PayPal address and keep it current — we are not responsible for money sent to an address you gave us in error.
  • Creators are responsible for their own taxes. Whalur does not withhold tax and does not give tax advice. Whatever you earn here, reporting it is your job.
  • Creators must only sell content they own. Do not sell research you copied from someone else, content you licensed under terms that forbid resale, or anything you do not have the right to distribute. Doing so is grounds for immediate removal, forfeiture of pending payouts, and account termination.
  • Creators must not make performance guarantees. You may describe what your research measured. You may not promise buyers a return, a win rate, or a profit.
  • Sales are between the creator and the buyer. Whalur provides the platform and the payment rails; we do not verify creator research, and buyers purchase at their own risk. Where we can, we will help resolve disputes, and we may refund a buyer and reverse the corresponding payout where a creator has clearly breached these terms.

6. Intellectual property

Whalur owns the platform: the site, the backtest and hypothesis engines, the rankings, the aggregate research, the branding, and the code behind them. We grant you a personal, non-exclusive, non-transferable licence to use it while your account is in good standing. That licence does not let you copy, resell or republish the platform or its research output.

Hypotheses and strategies you create remain yours. You keep ownership of what you write. You grant us the licence we need to host, store, back up, run, display and — where you made it public or sold access to it — distribute it on the platform, and to use anonymised, aggregated results for research and for improving the product. That licence ends for future use when you delete the content or your account, subject to the retention described in the Privacy Policy.

7. Availability

We do not promise any particular uptime. Whalur is developed continuously; features can change, and data feeds and backtest results can be delayed, incomplete or wrong. We may add, alter or remove features at any time.

8. Termination

You may stop using Whalur and delete your account whenever you like — see the Privacy Policy for how. We may suspend or terminate an account that breaches these terms, that is being used unlawfully, or that puts the service or other users at risk. If we terminate your paid account without cause, we will refund the unused portion of the current period. If we terminate it for a breach, we will not. Sections 1, 6, 9, 10 and 11 survive termination.

9. Disclaimer of warranties

Whalur is provided “as is” and “as available”, without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the service will be uninterrupted, secure or error-free, or that any measurement, ranking, backtest or signal is accurate, complete, or predictive of anything.

10. Limitation of liability

To the maximum extent the law allows, Whalur and its operators are not liable for trading losses, lost profits, lost data, lost opportunity, or any indirect, incidental, special, consequential or punitive damages arising from your use of the service — whether or not we were told such damages were possible. Our total liability for any claim relating to Whalur is limited to the amount you paid us in the twelve months before the claim arose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11. Indemnity

You agree to indemnify and hold Whalur harmless against claims, losses and reasonable legal costs arising from your breach of these terms, your misuse of the service, content you published or sold on it, or your violation of anyone else's rights.

12. Governing law and disputes

These terms are governed by the laws of the United States and of the state in which the operator is established, without regard to conflict-of-law rules. Before starting any formal proceeding, you agree to contact us at [email protected] and give us 30 days to resolve the matter. If any provision of these terms is held unenforceable, the rest stays in force.

13. Changes to these terms

We may update these terms. The “Last updated” date at the top will change, and for material changes we will email account holders before they take effect. Continuing to use Whalur after that means you accept the new terms; if you do not, cancel and stop using the service.
